Semi Truck Blown Tire – Will their Insurance take fault?

We recently got in a car accident with a semi car. The tire blew out on the semi as we were driving in the rear it (yes, we had genteel interval from the car, we were just about to pass it!). The hurt all appears to be ornamental, but we do hear weird noises when we try to break, but it is not a fixed blast.
